§ 28-157. Reclaiming vehicles; payment of expenses.

  • (a)

    Without court order or administrative decision. Any time before a motor vehicle or other vehicle is sold at public sale or disposed of as provided in this article, the owner or other person legally entitled to its possession may reclaim the vehicle by presenting to the police department having custody of the vehicle, proof of ownership or proof of the right to possession of the vehicle. No vehicle shall be released to the owner or other person under this section until all towing and storage charges have been paid.

    (b)

    With court order or administrative decision. At any time before a motor vehicle or other vehicle shall be released to its owner pursuant to court order or administrative decision, the owner or other person legally entitled to its possession may reclaim the vehicle by presenting to the police department having custody of the vehicle proof of ownership or proof of the right to possession of the vehicle. No vehicle shall be released to the owner or other person under this section until all reasonable towing and storage charges have been paid.

    (c)

    Payment of expenses required. Unless otherwise directed by a court order or administrative decision issued by an authorized court or administrative body, no vehicle shall be released to the owner, lienholder or other person under this section until all towing, storage and processing charges have been paid.
