§ 12-354. Rodent abatement for demolition/clearing projects.

  • (a)

    "Rodents" include rats, mice, and any other obnoxious or undesirable animals in, on or under structures.

    (b)

    All applicants for a demolition or a land surface modification permit and those persons undertaking a land clearing project above or below grade, shall initiate and complete a rodent baiting program on the project site at least seven days prior to the start of demolition, clearing or land surface modification activity.

    (c)

    The baiting program must continue at least seven days after said project has been completed, however, no demolition, clearing or land surface modification work shall commence until all significant rodent activity has been abated even if it has been 7 or more days since the initiation of the rodent baiting program, unless approved by the building official.

    (d)

    The rodent baiting program shall be approved by a qualified pest control agent and be consistent with the Illinois Structural Pest Control Act 225 ILCS 235/1 et. al. The use of any pesticides shall fully comply with the Illinois Structural Pest Control Act.

    (e)

    The building official shall not issue or deliver any demolition or land surface modification permit, nor shall any land clearing begin, until the applicant has filed with the village, a copy of the rodent baiting program.

    (f)

    The building official shall not issue or deliver any demolition or land surface modification permit, nor shall any land clearing begin, until the applicant posts a refundable $500.00 cash bond. Said bond shall be refunded once the building official has declared the project site abated of rodent activity.

    (g)

    The rodent baiting program may be terminated at any time, due to the lack of rodent activity, upon a written recommendation of the pest control agent or upon approval of the building official, however, the program must be reinstated upon discovery of additional rodent activity by the pest control agent or the building official and all work may be required to be stopped until the additional rodent activity has been abated.

    (h)

    At the discretion of the building official, a project unlikely to disturb a nesting place of rodents may be exempted from the requirements of this section.
